Consumer Complaint and Request for Investigation
I am filing this complaint to request a formal investigation into IMS Club LLC and Titan Relief Group Inc., their ownership, business practices, advertising, licensing compliance, and representations made to consumers.
I was solicited by IMS Club and sold a program that represented my timeshare weeks and getaways could be rented for profit. I paid approximately $2,394 based on these representations. Despite the promises made during the sales process, the services were not performed as represented and the promised results never materialized.
During my investigation of these companies, I reviewed Florida public records and found that IMS Club LLC lists Hiten Fountain as President and Christina Fountain as the registered agent. Public records for Titan Relief Group Inc. likewise identify Hiten Fountain and Christina Fountain as officers and principals of that company. These records indicate that the same individuals are involved in the ownership and operation of both companies.
I also searched Florida business and licensing databases and was unable to locate licensing information that would appear to authorize the activities being marketed to consumers. I request that the appropriate agency determine whether these companies possess all licenses, registrations, permits, and legal authority required under Florida law to provide the services they are advertising.
Further, I have serious concerns regarding the representations made concerning the rental of timeshare getaways and exchange inventory. My understanding is that many exchange programs, including those offered through RCI and Interval International, impose restrictions on the commercial rental of exchange inventory and getaway products. If consumers are being sold services based upon the rental of inventory that is not permitted to be rented under the applicable program rules, that raises significant concerns regarding the accuracy of the sales representations being made.
In addition to my own experience, I discovered numerous consumer complaints and negative reviews involving businesses associated with Hiten Fountain. Public BBB records identify Hiten Fountain as management of a timeshare-related company and reflect dozens of complaints and reviews from consumers alleging misrepresentations, failure to deliver promised services, and substantial financial losses.
The pattern I observed appears to be:
Consumers are solicited with promises of rental income or relief from their timeshare obligations.
Significant upfront fees are collected.
The promised results are not achieved.
Consumers experience communication issues and difficulty obtaining resolutions.
Related companies appear to operate under common ownership while marketing different services to the same consumer base.
Based on the information available to me, I believe there is sufficient cause for regulators to investigate:
Ownership and control of IMS Club LLC and Titan Relief Group Inc.
Licensing and regulatory compliance.
Advertising and marketing representations made to consumers.
Collection of upfront fees.
Consumer complaints and fulfillment practices.
Potential violations of Florida's Deceptive and Unfair Trade Practices Act.
I respectfully request a full investigation and any enforcement action deemed appropriate. I am prepared to provide contracts, invoices, payment records, emails, call recordings, marketing materials, screenshots, public records, and any additional documentation necessary to assist with this matter.
