Absolute nightmare experience dealing…
Absolute nightmare experience dealing with Auction House South Yorkshire regarding 32c Rutland Street, Filey. This company completely fails in its basic duty of care and due diligence. They list and sell properties without verifying if the vendor actually possesses the legal right to sell them.They allow highly restrictive, completely one-sided legal packs that intentionally omit crucial title documentation. Buyers are held to an aggressive 14-day completion deadline while the auction house protects uncommunicative sellers. It feels entirely engineered as a manufactured money-making scheme to trap and seize substantial consumer fees. They took £3,600 from us for a service they failed to safely provide. We are not the first to experience this pattern of behavior. Avoid this platform at all costs unless you want your money trapped in a broken transaction. Trading Standards and the Property Ombudsmen have been formally notified.

It was our first time auctioning a property so were quite nervous, but Sam was incredibly supportive and we had a really positive experience. He was always on hand to answer any queries and guided us through the whole process. And we achieved a really good end result!

The whole experience was something of a nightmare. Auction House was totally uncooperative in every way. From bidding to completion was a nightmare. They really shouldn't be allowed to sell properties with such an opaque legal pack. The legal pack said it was a 999 year lease from 2004 but did not mention that it had been reduced to 125 year lease. Quite a major issue I would think. My solicitors were so alarmed that they asked me to sign a disclaimer absolving them from responsibility. Auction House straight refused to answer any questions and refused to put me in touch with the seller to determine certain details for the insurance. They demanded a massive up-front payment of £12,500 (a miscalculation and they refunded £1000) but never issued a receipt. I then found that I had bought it only days after the previous owner completed, meaning that it was being offered in the auction before the seller even owned it. Felt like having been fobbed off with a hot potato. They also hid the ground rent and service charges, which turn out to be surreally expensive. It has been a truly horrible experience and I regret assuming that there was a certain level of openness to be expected from an auctioneer who relies on public trust. I previously bought with SDL and they were extremely helpful and issued a receipt for the deposit and were in stark contrast to Auction House. I don't like to leave a bad review but this was an immensely unpleasant experience.

Thank you for your review. We are sorry to hear that you found the process difficult, however we would like to clarify a number of points for transparency.
The legal pack for auction properties is prepared by the seller’s solicitors, not by the auctioneer. Our role is to make this information available to prospective bidders so they and their solicitors can carry out due diligence before bidding. As with all auction purchases, buyers are expected to review the legal documentation carefully and seek professional advice prior to the auction.
The legal pack provided included the Land Registry title and related documents. These confirm the lease details and also reference a later deed of variation recorded against the title. The special conditions also confirm that the property is sold subject to the documents contained in the pack and that buyers are deemed to purchase with knowledge of those documents.
Regarding the payment requested following the auction, the required amounts were clearly set out in the legal pack: an £8,000 deposit together with the applicable buyer’s administration fee. A member of our team did initially request an incorrect figure due to a simple administrative error; however this was identified within minutes, corrected immediately and the overpayment refunded as quickly as possible.
You also raised concerns about the seller only recently completing their own purchase. This situation can occur in auction transactions, and the legal pack specifically addressed this possibility, confirming that the buyer must accept that the seller may not yet be the registered proprietor at the time of completion.
Our records show that our team responded promptly and courteously throughout the process. Where questions related to legal or title matters, these appropriately needed to be addressed by the seller’s solicitors rather than the auctioneer.
We are sorry that the experience did not meet your expectations, but the sale was conducted in accordance with the auction terms and documentation provided prior to bidding. If you would like to discuss any of the points further, please feel free to contact our office directly.

The seller did not inform us that the property was of non-standard construction, and there were no visible indicators during marketing or inspections to suggest that this was the case. From its external appearance, the property presents as traditional brick-built construction.
We also note that you viewed the property after exchange of contracts and prior to completion. At no stage during or after this viewing were any concerns raised with us regarding construction type, and no enquiries were made before completion.
As an auction house, we act on information provided by the seller and do not carry out structural or intrusive investigations. We strongly encourage all buyers to undertake their own due diligence, including instructing a solicitor and, where appropriate, a surveyor, prior to bidding and exchange.
