Misleading Marketing
A return of up to 12% per year on a hands off property investment is not normal in regulated finance. Itâs typical of: Loan Notes, unregulated property finance and high risk property schemes.
Devete is only an introducer with no responsibility they do not hold your money, do not guarantee your return, do not offer FSCS protection even for their developer and do not carry any financial responsibility if the developer fails. They just get a commission for âfinding youâ.
A corporate guarantee is not cash sitting in a bank. It is simply a promise from a company to repay you if something goes wrong. For it to be meaningful, the guarantor must have: strong assets, low debts, positive cashflow, a history of responsibility,no charges over its assets and no insolvency risk. A â£30M corporate guaranteeâ is only as good as the company behind it and a problem in one project that your money may fund can result in you losing your investment with no reimbursement. It will not be FSCS covered. Devette states the company they are encouraging you to invest in has a great track record nevertheless you are taking a risk. One financial problem in the project your money is used for can lose it all.
Concerning IHT mitigation most property backed fixed return investments do NOT qualify for Business Relief. For an asset to be outside your estate for IHT purposes, it usually needs to meet one of these conditions: you no longer control it, you no longer benefit from it, you held it in a qualifying structure for at least 2 years (eg. business relief), it qualifies as a trading business asset not an investment product. A loan note to a property developer is a fixed term investment , not a trading business, not a qualifying asset for business relief and is not automatically exempt from IHT. A loan note remains part of your estate and is subject to IHT.
The bottom line is that you might do very well with Devette's recommendations or you might lose all; you are taking a risk. Re IHT it will need a lot more investigation. If you are younger the risk with a modest amount of money you can afford to lose could be a good gamble but for retirees with some capital and some pensions payments, but no regular income it seems unadvisable.
