Dear Ms. Saafan,

Thank you for taking the time to write a review. We understand your frustration and recognise that our customers need their deposits back for the next stage in their lives. However, we regret you are blaming City-Wohnen, and we vehemently reject the accusation that our agency is holding the deposit in order to profit from the interest. We would like to restate the facts that we have already communicated to you on several occasions:


- The lease agreement is between you and the lessor. City-Wohnen holds your deposit in an escrow account on behalf of your lessor, but we can only release the deposit once we have received the lessor's approval to do so.

- As per your lease agreement, "After the tenancy ends, the deposit must be paid back to the lessee within a reasonable time so long as no claims against the lessee arising from the tenancy exist or may be expected." This is from German Civil Code BGB § 551 for deposits. We are aware that the phrase "a reasonable time" is not as clearly defined as our lessees would like, but this is the law.

- Before the end of your lease, we sent you an information sheet about the return of the deposit. As per that information, refunds generally take approximately 4-6 weeks when the utiliies are included in the rent as a lump sum and the apartment is returned in good condition. Your refund is taking a little longer, but it is still within the legally permitted timeframe. Perhaps there has been a misunderstanding, but we do not believe we told you the refund would take 3-6 months. From our understanding, we informed you that 3-6 months is still generally considered as "a reasonable time" for the refund to take if there are possible claims.

- Your deposit is still being held due to such a possible claim. Your lease did not include a lump sum for electricity but rather a prepayment. As per your lease, "prepayments for utilities are to be accounted for in accordance with German Civil Code (§ 556 para. 3 BGB), whereas lump sums are not. If the rental parties agree on prepayments, the meter readings from the handover and return of the apartment will be the basis for settling accounts."

- As you are aware, it has been difficult to ascertain the actual usage because the meter was changed during your lease. As we and your lessor have assured you, there is already ongoing communication with the electricity provider to establish the correct figures. As soon as these figures are available, your deposit will be refunded, minus the final cleaning costs and the amount agreed for damages. If you used less electricity than the prepayment, the difference will be credited to you. If you used more, the difference will be deducted.

Regarding your point about interest on the deposit: In Germany, the renter is entitled to this interest at the current interest rate (currently 0,4000%). Please note that bank fees may apply and offset earned interest.

vielen Dank für Ihr gutes Feedback. Wir freuen uns sehr, dass Sie mit der Vermittlung und Abwicklung durch unsere Agentur so zufrieden waren. Das Thema Kaution ist sehr wichtig, und wir bemühen uns stets, Mieter und Vermieter über ihre Rechte und Pflichten aufzuklären. Wir verstehen, dass Mieter die Kaution für die nächste Phase ihres Lebens benötigen und sie deshalb schnell zurückhaben wollen. Im Mietvertrag steht ,,Die Kaution ist nach Beendigung des Mietverhältnisses innerhalb angemessener Zeit zurückzuzahlen, soweit gegen die Mieterin/ den Mieter keine Ansprüche aus dem Mietverhältnis bestehen oder zu erwarten sind (siehe BGB § 551)." Das Gesetz lässt den Zeitraum daher etwas offen (angemessener Zeit) und in der Tat ist es nicht unüblich, ca. 6 Wochen auf die Rückzahlung zu warten. In der Regel hängt es damit zusammen, dass auf Rechnungen gewartet wird, sei es auch nur für die Endreinigung.
Wir schätzen Ihr Feedback und werden es bei der weiteren Zusammenarbeit mit Ihrem Vermieter berücksichtigen. Wir nehmen Beschwerden ernst und arbeiten nicht mit Vermietern zusammen, die unverantwortlich mit Kautionen umgehen.
Wir wünschen Ihnen alles Gute für Ihre nächste Station im Leben und hoffen, Sie haben eine schöne Zeit in Hamburg gehabt!
